1.1. These Terms of Use (hereinafter the “Terms”) govern the rights and obligations arising from the use of the website kaiserquarry.com (hereinafter the “Website”) and related services operated by:

1.2. By accessing and using the Website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website.

1.3. These Terms are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 480/2004 Coll., on Certain Information Society Services.

1.4. The provision of KQS services to customers (Story · System · Shield) is governed by an individual service agreement. These Terms apply subsidiarily to the contractual relationship with customers, unless otherwise stipulated in the agreement.

2.1. Kaiser Quarry Studios is a digital studio that delivers comprehensive digital solutions to customers through three pillars:

Story — Visual narrative. Every website is an original work — a unique scene, not a template instance.

System — Digital infrastructure. The Vesna Platform provides modular business logic (commerce, booking, billing, notifications, customer portal).

Shield — Legal and process assurance. Compliance, contractual documentation, process audit — integrated into delivery, not an afterthought.

2.2. The Website kaiserquarry.com serves as the presentation and reference platform for KQS. It contains a project portfolio, service descriptions, and inquiry forms.

2.3. The Operator reserves the right to expand, restrict, or modify the scope of services available on the Website at any time without prior notice.

3.1. Access to certain services (business panel, project management) requires the creation of a customer account on the Vesna Platform.

3.2. The customer is obliged to:

• provide accurate and truthful information upon registration,
• protect access credentials (email, password) from unauthorised access,
• promptly notify the Operator of any suspected misuse of the account,
• refrain from using the account in a manner that could harm the Operator or third parties.

3.3. The Operator reserves the right to suspend or terminate a customer account in the event of a breach of these Terms or contractual obligations.

3.4. Details regarding service provision, pricing, SLA, and mutual rights and obligations of the customer and KQS are subject to an individual agreement.

4.1. The user agrees to use the Website in accordance with these Terms, applicable legislation, and good morals.

4.2. The user shall not, in particular:

• interfere with the security, technical infrastructure, or content of the Website or the Platform,
• use the Website or the Platform in a manner that could harm the Operator or third parties,
• distribute through the Website any content that is unlawful, offensive, discriminatory, or otherwise objectionable,
• use automated tools (bots, scrapers, etc.) to systematically download Website content without the Operator's express consent,
• attempt unauthorised access to the Operator's systems,
• reproduce, decompile, or reverse-engineer the Vesna Platform or any of its components.

5.1. All content on the Website — including texts, graphics, logos, icons, images, audio and video materials, software, databases, and visual scenes — is protected by copyright and other intellectual property rights belonging to the Operator or third parties who have licensed such content to the Operator.

5.2. Without the Operator's express written consent, it is not permitted to copy, reproduce, distribute, modify, publicly display, or otherwise use the Website content beyond the scope of personal non-commercial use.

5.3. The names “Kaiser Quarry”, “Kaiser Quarry Studios”, “KQS”, the KQ logo, and related graphic elements are trade designations of the Operator. Their use by third parties without the Operator's consent is prohibited.

5.4. The Vesna Platform, its source code, architecture, modules (Commerce, Booking, Billing, Pulse, Portal), tools (vesna-cli, kqs-tokens), and documentation are the intellectual property of the Operator.

5.5. Visual Scenes — original works created by KQS for specific projects — are the intellectual property of the Operator, unless otherwise stipulated in the customer agreement.

5.6. Project names, game titles, and game world names (including “Chain of Evidence”, “Velesia”, “Morana”, “Tessera”, “Gamayun”, and others) are the intellectual property of the Operator.

5.7. AI-generated content: Visual and textual content created in collaboration with AI tools forms part of KQS's original works and is subject to the same protection as other Website content. Specific rights to AI-generated content within customer projects are governed by the individual agreement.

6.1. The Operator provides the Website “as is”. The Operator does not guarantee uninterrupted availability of the Website or the accuracy of its content.

6.2. The Operator shall not be liable for:

• damages resulting from the inability to access the Website or its malfunction,
• damages resulting from reliance on information provided on the Website,
• the content of third-party websites linked from the Website,
• actions of third parties in connection with the Website.

6.3. Liability for the availability and functionality of the Vesna Platform in relation to customers is governed by the individual service agreement and any applicable SLA terms.

6.4. The Operator reserves the right to temporarily or permanently disable the Website or any part thereof at any time without prior notice, particularly for maintenance, updates, or security measures.

6.5. The limitations of liability under this Section shall not apply to the extent they conflict with mandatory provisions of Czech law, in particular Section 2898 of the Civil Code.

7.1. The Website may contain links to third-party websites or services. The Operator has no control over the content of such websites and bears no responsibility for them.

7.2. Following links to third-party websites is always at the user's own risk. We recommend reviewing the terms of use and privacy policies of such websites.

8.1. The processing of personal data is governed by the separate Privacy Policy.

8.2. The use of cookies and similar technologies is governed by the Cookie Policy.

9.1. The Operator reserves the right to amend or supplement these Terms unilaterally at any time.

9.2. Amended Terms will be published on the Website with the date of last update indicated. By continuing to use the Website after the amended Terms are published, you agree to the new version.

9.3. In the event of material changes, the Operator will make reasonable efforts to notify users (e.g., by a notice on the Website), or by email for registered customers.

10.1. These Terms are governed by the laws of the Czech Republic.

10.2. All disputes arising in connection with these Terms shall be resolved by the competent courts of the Czech Republic.

10.3. If the user is a consumer within the meaning of Section 419 of the Civil Code, they have the right to out-of-court settlement of consumer disputes. The relevant body is the Czech Trade Inspection Authority (www.coi.cz). Consumers may also use the online dispute resolution platform established by the European Commission at https://ec.europa.eu/consumers/odr/.

If any provision of these Terms is found to be invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions.
